Terms of Service

These are the terms you agree to when you reserve early TestFlight access to Tethr. Plain English with the legal specifics where they matter. For product or billing questions, write hi@trytethr.app. For legal matters, support@fastshot.ai.

Who we are

These Terms are a legal agreement between Fastshot, Inc. ("Fastshot," "we," "us," "our"), operator of fastshot.ai and Tethr (the iOS follow-up assistant for ADHD adults), and you ("you" or "User").

What you're buying

You're reserving early TestFlight access to Tethr, an iOS app currently in beta. After your TestFlight invite arrives, you have access to the app on your iOS device for as long as your subscription remains active.

This is an early build, not the final App Store version. See Beta Software below.

Eligibility

To buy and use Tethr you must:

Subscription terms

You agree to the following recurring charges:

Billing cycle: Monthly, starting on the day of your first payment.

Recurring charge acknowledgment: By clicking the reserve button and checking the agreement checkbox, you authorize Tethr (through Stripe) to charge your payment method automatically on each renewal date until you cancel. You acknowledge that your subscription continues until canceled.

Price changes: We will not raise your monthly price above $14.99 USD during your subscription except with 30 days' written notice. If we raise the price, you can cancel before the new price takes effect.

Currency and taxes: Prices are in US dollars. Where applicable taxes apply, they will be added at checkout and clearly displayed.

Card on file: Stripe processes your payment. We do not store your card number. If your card expires or fails, Stripe attempts to charge again over the following 7 days and we will notify you by email.

Cancellation

You can cancel any time, for any reason, by:

Cancellations take effect at the end of the current billing period. You will not be charged again after cancellation. You retain access through the end of the period you've paid for.

Refund policy

The May 26 commitment:

If we do not deliver your TestFlight invite by 11:59 PM Pacific Time on May 26, 2026, you are entitled to a full refund of the $8.99 you paid. Email hi@trytethr.app with "Refund" in the subject. We will issue the refund within 5 business days.

We will also proactively refund anyone who has not received a TestFlight invite by end-of-day Pacific Time on May 26, without requiring a request.

Other refunds:

Canceling your subscription stops future charges but does not automatically refund the current billing period beyond the 7-day window.

Beta software

Tethr is currently distributed as a TestFlight beta build. This means:

Acceptable use

By using Tethr, you agree not to:

Intellectual property

Tethr (the app, the brand, the design, the code, the marketing copy) is owned by Tethr. You receive a limited, non-exclusive, non-transferable license to use the app for personal, non-commercial purposes while your subscription is active.

Anything you create using Tethr (reminders, notes) is yours. You give us a limited license to process and display it as needed to provide the service.

Privacy

How we handle your data is described in our Privacy Policy. By using Tethr you agree to that policy.

Disclaimers

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE." TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON‑INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE ERROR‑FREE, SECURE, OR UNINTERRUPTED, OR THAT ANY REMINDER WILL FIRE AT ANY SPECIFIC TIME OR THAT ANY ESCALATION WILL REACH YOU.

Tethr is not a medical device. Nothing in the app is medical advice. Do not use Tethr as your sole reminder for medication dosing, medical appointments, or any other safety-critical task. You should not rely on AI-generated outputs or automated reminders for decisions with legal, medical, financial, or other high-risk consequences without independent verification.

Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW: (A) NEITHER PARTY IS LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, LOST REVENUE, OR LOST DATA, OR FOR DAMAGES ARISING FROM MISSED APPOINTMENTS, MEDICATIONS, DEADLINES, OR ANY OTHER CONSEQUENCE OF A REMINDER NOT FIRING; (B) EACH PARTY'S AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THE SERVICES IS LIMITED TO THE GREATER OF (I) THE AMOUNTS PAID BY YOU TO FASTSHOT FOR TETHR IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO LIABILITY OR (II) ONE HUNDRED U.S. DOLLARS ($100). THESE LIMITATIONS APPLY EVEN IF A REMEDY FAILS OF ITS ESSENTIAL PURPOSE. Some jurisdictions do not allow these exclusions; in those jurisdictions, our liability is limited to the maximum extent permitted by law.

Indemnification

You will defend and indemnify Fastshot and its affiliates, directors, employees, and agents against any claim, damages, losses, and expenses (including reasonable attorneys' fees) arising out of your (a) misuse of the service, (b) violation of these terms, or (c) infringement of third-party rights by your content.

DMCA & copyright

If you believe content on Tethr infringes your rights, please send a notice to support@fastshot.ai with: (a) your contact details; (b) identification of the work and the allegedly infringing material; (c) a statement under penalty of perjury that you have a good-faith belief that the use is not authorized; and (d) your physical or electronic signature. We may remove or disable access to the material and, where appropriate, terminate repeat infringers.

Changes to terms

We may update these terms. If a change is material, we'll email you at least 30 days before the change takes effect. Continued use after the change means you accept the new terms. If you don't accept, your remedy is to cancel before the change takes effect (you'll get a refund of the unused portion of your current billing period).

Either side can end the relationship:

Governing law and disputes

Governing law. These terms are governed by the laws of the State of California, USA, without regard to its conflict-of-laws principles.

Arbitration. Any dispute arising out of or relating to these terms or the service will be resolved by binding individual arbitration under the rules of JAMS or the American Arbitration Association (AAA). The arbitration will be conducted in English. Judgment on the arbitrator's award may be entered in any court of competent jurisdiction.

No class actions. You waive any right to bring or participate in a class action, class-wide arbitration, or representative proceeding against Fastshot.

30-day opt-out. You may opt out of arbitration within 30 days of first accepting these terms by emailing support@fastshot.ai with "Arbitration Opt-Out" in the subject line.

Exception. Either side can bring a claim in small-claims court if it qualifies.

If any provision of these terms is unenforceable, the rest remain in effect.
